1. Acceptance of Terms

By downloading, installing, or using the FireLock application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and FireLock ("we," "us," or "our").

2. Description of Service

FireLock provides a secure, encrypted storage solution for your private photos and videos. Key features include:

• Military-grade AES-256 encryption for all stored content
• Local storage on your device
• Optional encrypted cloud backup to your personal Dropbox account
• Biometric authentication (Face ID, Touch ID)
• Decoy mode for additional security

The App is designed to protect your privacy using zero-knowledge encryption, meaning we cannot access your encrypted data. When you use Dropbox backup, files are stored in your personal Dropbox account - you maintain full control and FireLock does not access your backup data.

3. User Accounts & Responsibilities

Account Creation

You may need to create an account to use certain features of FireLock. When creating an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Choose a strong master password
• Notify us immediately of any unauthorized access

Password Management

Your Responsibilities

You are responsible for:

• All content you store in the App
• Maintaining the confidentiality of your password
• All activities that occur under your account
• Ensuring your use complies with applicable laws

4. Acceptable Use Policy

Permitted Use

FireLock is intended for personal use to securely store your private photos and videos.

Prohibited Activities

You agree NOT to use FireLock to:

• Store or distribute illegal content, including child exploitation material
• Store content that infringes on intellectual property rights of others
• Engage in any illegal activities
• Attempt to reverse engineer, hack, or compromise the App's security
• Upload malware, viruses, or malicious code
• Share your account with others or create multiple accounts to abuse the service
• Use the App in any way that could harm, disable, or impair our services

5. Intellectual Property Rights

Our Rights

The FireLock App, including all software, design, graphics, and content, is owned by FireLock and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute the App
• Reverse engineer or decompile the App
• Remove or alter any copyright notices
• Use our trademarks without permission

Your Content

You retain all rights to the photos and videos you store in FireLock. We claim no ownership over your content. Due to encryption, we cannot access or use your content in any way.

6. Privacy & Data Protection

Your privacy is extremely important to us. Our use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key privacy commitments:

• Zero-knowledge encryption - we cannot access your data
• No data collection for advertising purposes
• Minimal data collection (only what's necessary to provide the service)
• No selling of user data to third parties

7. Payments & Subscriptions

FireLock may offer free and premium subscription tiers:

Free Tier

Basic features are available for free with certain limitations (e.g., storage limits, feature restrictions).

Premium Subscriptions

• Subscriptions are billed through the Apple App Store
• Pricing is displayed in the App and subject to change with notice
• Subscriptions auto-renew unless canceled at least 24 hours before the renewal date
• Manage or cancel subscriptions through your App Store account settings
• Refunds are handled according to Apple's refund policy

Changes to Pricing

We reserve the right to modify subscription pricing. We will notify existing subscribers before any price increases take effect.

8. Disclaimer of Warranties

FireLock is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be error-free or uninterrupted
• Warranties regarding the security of your data (although we use industry-standard encryption)

9. Limitation of Liability

To the maximum extent permitted by law, FireLock shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or other intangible losses
• Damages resulting from unauthorized access to your account
• Damages resulting from forgotten passwords or lost encryption keys
• Service interruptions or technical failures

Our total liability to you for any claims arising from your use of FireLock shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

10. Indemnification

You agree to indemnify and hold FireLock harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any laws or regulations
• Content you store in the App
• Your infringement of any third-party rights

11. Termination

Termination by You

You may stop using FireLock at any time by:

• Uninstalling the App
• Deleting your account through the App settings

Termination by Us

We reserve the right to suspend or terminate your account if:

• You violate these Terms
• Your use poses security or legal risks
• You engage in fraudulent or abusive behavior
• Required by law or legal process

Effect of Termination

Upon termination:

• Your right to use the App immediately ceases
• You will lose access to encrypted data stored in the cloud
• Data stored locally on your device will remain until you delete the App
• No refunds will be provided for unused subscription time (except as required by law)

12. Changes to Terms

We may update these Terms from time to time. When we make changes:

• We will update the "Last Updated" date at the top
• We will notify you through the App or via email for material changes
• Your continued use after changes constitutes acceptance of the new Terms

If you do not agree to the updated Terms, you must stop using FireLock.

13. Governing Law & Dispute Resolution

Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.

Dispute Resolution

Before filing a lawsuit, you agree to first contact us at [email protected] to attempt to resolve any disputes informally.

Arbitration

For disputes that cannot be resolved informally, you agree to binding arbitration rather than court proceedings, except for disputes involving intellectual property rights or small claims court matters.

14. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FireLock.

Severability

If any provision of these Terms is found to be invalid, the remaining provisions will remain in full effect.

No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms. We may assign these Terms without restriction.

Third-Party Services

FireLock integrates with third-party services (e.g., iCloud). Your use of those services is governed by their respective terms.
